§1. General provisions

1. These terms and conditions (“Terms and Conditions”) specify the rules of functioning of the SENiTy partner program (“Program”).
2. The Organizer of the Program is Sen Jewelry (“Organizer”).
3. The SENiTy Program is addressed to stylists, content creators, influencers and people operating in the area of fashion, design and jewellery aesthetics.
4. The Terms and Conditions constitute a framework agreement on cooperation between the Organizer and the Participant.
5. Participation in the Program is voluntary and free of charge.

§2. Definitions

1. Participant – a natural person or an individual conducting business activity, admitted to the Program after positive verification.
2. Candidate – a person who submitted an application to the Program, but has not yet been admitted.
3. SENiTy Code – an individual discount code assigned to the Participant.
4. Cashback (Commission) – promotional value in the amount of 10% on qualifying orders placed using the SENiTy Code, recorded on the Participant’s individual balance and intended exclusively for use in the Sen Jewelry store.
5. Customer – a person making a purchase using the SENiTy Code.

§3. Application to the Program and verification

1. Joining the Program takes place by filling out the application form and accepting the Terms and Conditions and required consents.
2. Submitting an application is not equivalent to automatic admission to the Program.
3. Each application is subject to internal verification by the Organizer at its discretion.
4. The Organizer reserves the right to accept the Candidate, refuse admission or temporarily withhold the decision.
5. The Candidate is informed of admission to the Program by email.

§4. Rules of the Program

1. Each Participant is assigned an individual SENiTy Code.
2. Customers using the SENiTy Code receive a 10% discount on orders.
3. The Participant receives 10% cashback on the value of orders placed using their SENiTy Code.
4. Cashback is non-monetary and is recorded on the Participant’s individual balance as funds to be used in the Sen Jewelry store (www.sen-jewelry.com, Instagram).
5. Cashback is calculated conditionally and becomes final only in relation to orders:
   • paid,
   • unreturned,
   • not covered by a complaint resulting in a refund.
6. In the event of a return, order cancellation or accepted complaint, the corresponding cashback value is reduced or cancelled accordingly.

§5. Settlement of cashback

1. Cashback is settled monthly, after the end of each full calendar month.
2. Crediting cashback to the Participant’s balance occurs within up to 30 days after the end of the given month and covers exclusively orders meeting the conditions specified in §4.
3. Cashback can be used exclusively to lower the price of products available in the Sen Jewelry store.
4. Cashback is not subject to payout in cash or exchange for cash.
5. Cashback cannot be used to purchase gift cards or products subject to individual pricing, unless the Organizer decides otherwise.
6. The Organizer reserves the right to verify transactions and adjust the cashback balance in case of abuse or attempts to circumvent the Terms and Conditions.
7. Cashback does not combine with other promotions, discounts or discount codes, unless the Organizer decides otherwise.

§6. Barter cooperation

1. The Organizer may propose barter cooperation to the Participant.
2. Details of barter cooperation are determined individually.
3. Barter arrangements constitute a supplement to these Terms and Conditions.

§7. Publishing content

1. The Participant undertakes to publish content compliant with the law, good practice and the aesthetics of the Sen Jewelry brand.
2. It is forbidden to use the SENiTy Code in contexts violating the good name of the Organizer.
3. The Organizer reserves the right to suspend or deactivate the SENiTy Code in the event of violations.

§8. Liability

1. The Organizer bears no liability for content published by Participants.
2. The Participant bears full responsibility for the manner of using the SENiTy Code.

§9. Personal data (GDPR)

1. The administrator of personal data is the Organizer.
2. Data are processed for the purpose of implementing the Program and – in the case of granting consent – for marketing purposes.
3. The Participant is entitled to rights resulting from GDPR.

§10. Termination of participation in the Program

1. The Participant may resign from participation in the Program at any time.
2. The Organizer may terminate the Participant’s participation in the Program in the event of a breach of the Terms and Conditions.
3. After termination of participation in the Program, the SENiTy Code is deactivated.
4. The accumulated cashback can be used in the Sen Jewelry store within 6 months from the date of termination of participation in the Program, after which unused funds expire.

§11. Final provisions

In matters not regulated by the Terms and Conditions, the provisions of Polish law apply.

The Terms and Conditions are effective from the date of publication.

The Organizer reserves the right to make changes to the Terms and Conditions.
